Thank you to the strong Court of Appeal in Churchill v Merthyr Tydfil County Borough Council in November of 2023 for finding the Court does have the power to order parties to use ADR, and in particular mediation.


It has taken 20 years for the Court to recognise that they always had the power to order a stay of proceedings to mediation or other forms of ADR and the worry that it did not was easily overcome, thanks to

the forceful advocacy of Michel Kallipetis, spelling out that the previous precedent was not in fact a precedent at all, but a 'by the way' comment of no binding effect. Where there is the will there is the way.

 

I welcome and applaud this law change.

 

PS I am still waiting to hear a client say that they had a good time in litigation.
